1. Agreement to Terms

By accessing or using the services provided by Lumina Speaking Arts ("we," "our," or "us"), you agree to be bound by these Terms and Conditions. These terms apply to all visitors, users, and clients who access our website or participate in our coaching programs, workshops, and digital learning platforms. If you do not agree with any part of these terms, you may not access our services. Our goal is to provide a professional and supportive environment for communication excellence, and these terms ensure a clear understanding of our mutual obligations.

2. Coaching & Workshop Bookings

All bookings for private consultations, courses, and workshops are subject to availability. A booking is considered confirmed only upon receipt of the required deposit or full payment as specified at the time of purchase. We reserve the right to refuse service or cancel a booking at our discretion, in which case a full refund of any unearned fees will be provided. For our 'Signature Series' and 'Executive Retainer' packages, a formal coaching agreement may be required, outlining specific deliverables and timelines.

3. Cancellation & Rescheduling Policy

We value your time and the time of our coaches. For private consultations, we require at least 48 hours' notice for any cancellation or rescheduling request. Cancellations made with less than 48 hours' notice will incur a fee equal to 50% of the session rate. Cancellations made with less than 24 hours' notice, or 'no-shows,' will be charged the full session rate. For workshops and courses, cancellations made more than 14 days before the start date will receive a full refund minus a 10% administrative fee. No refunds will be issued for cancellations made within 14 days of the start date, although we may allow you to transfer your registration to a future session at our discretion.

4. Intellectual Property

All materials provided during our training—including but not limited to the Lumina Method framework, narrative builders, course handbooks, and video tutorials—are the intellectual property of Lumina Speaking Arts and are protected by copyright laws. You are granted a limited, non-exclusive license to use these materials for your personal professional development. You may not reproduce, distribute, or create derivative works from our materials without our explicit written consent. Conversely, any original content you create during our coaching—such as speech drafts and personal narratives—remains your intellectual property. We claim no ownership over your authentic message.

5. Client Conduct & Studio Rules

We are committed to maintaining a safe, inclusive, and professional environment for all students and staff. We expect all clients to behave respectfully and professionally during sessions and workshops. Any form of harassment, discrimination, or disruptive behavior will result in immediate termination of service without refund. When visiting our Austin studio, you agree to follow all safety guidelines and respect our equipment. Professional recording of our sessions by clients is only permitted with the prior approval of the coach.

6. Limitation of Liability

While we strive to provide the highest quality coaching and narrative design, Lumina Speaking Arts does not guarantee specific professional outcomes, such as winning a pitch, securing a promotion, or receiving a specific response from an audience. Communication success depends on numerous factors beyond our control, including your own preparation and practice. In no event shall Lumina Speaking Arts be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with our services.

7. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising under these terms shall be brought exclusively in the courts located in Travis County, Austin, Texas.
